A 41-year-old Chaska man with a history of criminal sexual conduct was arrested on Monday afternoon after allegedly exposing himself while in the vicinity of two young females outside an Excelsior business. He was apprehended in Chaska later that day and formally charged on June 17 with the felony level offense of Fifth Degree Criminal Sexual Conduct.
On the afternoon of June 15 the South Lake Minnetonka Police Department (SLMPD) was dispatched to Dunn Bros Coffee in downtown Excelsior on suspicion that the man had exposed his genitalia several times while seated in the patio area outside the business.
According to the criminal complaint, he "was wearing short black shorts and crossed his legs in such a manner" that he exposed himself. The suspect reportedly left in a van, but the person who reported the incident had obtained the license plate number and gave it to the officer along with a description of the suspect. The reporting party selected the suspect from a six-person photo line-up.
The Chaska Police Department was requested to watch for the suspect vehicle. Shortly thereafter the suspect, Jon Theis, was taken into custody in Chaska and turned over to the SLMPD. A records check of the suspect revealed this was not the first time he had been arrested for this type of criminal behavior. Theis was convicted in Carver County of similar charges in 2003.
Theis was subsequently booked at the Hennepin County Adult Detention Center in Minneapolis. Bail was set at $10,000 with conditions attached to his release.
